The City Council is deciding whether building permits can be issued on swimming pools, spas and decorative water features.
The City could decide on whether 54 building permits that have some sorts of pool, spa and or decorative water feature could proceed in the design review process.
The specific discussion is included in tonights proposed Agenda.
The specific discussion regarding the building of pools and spas and decorative water features in Laguna Beach is as follows:
ORDINANCE ESTABLISHING REGULATIONS RELATED TO SWIMMING POOLS, SPAS AND DECORATIVE WATER FEATURES DURING THE DROUGHT EMERGENCY
Proposal to identify regulatory options regarding swimming pools,
specifically including the disposition of pending applications for swimming pools
and water reduction policies to help conserve water.
STAFF REPORT
1) Adopt the Ordinance entitled,
“AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAGUNA BEACH, CALIFORNIA, THAT TEMPORARILY
(1) MANDATES THE USE OF POOL COVERS FOR ALL SWIMMING POOLS AND SPAS AND
(2) PROHIBITS THE ACCEPTANCE OF APPLICATIONS, ISSUANCE OF DESIGN REVIEW APPROVALS AND ISSUANCE OF BUILDING PERMITS FOR DECORATIVE WATER FEATURES AND PONDS, AND DECLARING THE URGENCY HEREOF PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 36937”
an urgency measure requires 4/5ths vote to mandate the use of covers for all swimming pools and spas,
and to prohibit City approval for decorative water features unless a non-potable water fill system is identified and installed.
2) Determine whether or not to prohibit the construction of future swimming pools and spas during the pendency of emergency drought conditions.
a. If there is not a desire to limit the approval and construction of new swimming pools, no additional changes to the proposed ordinance are necessary; or
b. If there is a desire to prohibit the construction of new swimming pool and spa applications during the drought, it is recommended that the adoption of the proposed urgency ordinance (4/5ths vote required) include a prohibition on the issuance of building permits for swimming pool and spa applications received by the City after July 14, 2015,
although applicants could pursue and obtain design review approvals.
This action would allow the 54 pending applications received prior to the moratorium to move forward for design review and, if approved, to obtain building permits and proceed with construction (this is Option II discussed earlier in the Agenda Bill).
3) Adopt the Ordinance entitled, “AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAGUNA BEACH, CALIFORNIA, REPEALING ORDINANCE NO. 1602 RELATING TO A 45-DAY MORATORIUM ON APPROVALS OF DESIGN REVIEW APPLICATIONS FOR CONSTRUCTION OF SWIMMING POOLS”
(simply majority vote required) to repeal Ordinance No. 1602, which will immediately end the moratorium.
